1. Acceptance of Terms
By accessing or using the SecondGear Harley Parts Marketplace ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, users, buyers, sellers, and others who access or use the Platform.
2. Account Registration
To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
- You are responsible for safeguarding your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- You must be at least 18 years old to create an account.
- Each person may maintain only one account.
3. Marketplace Rules
For Sellers
- Listings must accurately describe the part being sold, including condition, compatibility, and any defects.
- All parts must be genuine Harley-Davidson or aftermarket parts clearly labeled as such.
- Sellers must ship items within the timeframe specified in their listing.
- Sellers are responsible for proper packaging to prevent damage during shipping.
- Counterfeit, stolen, or prohibited items are strictly forbidden.
- Sellers must respond to buyer inquiries and disputes in a timely manner.
- Listing prices must be in US Dollars (USD).
For Buyers
- Buyers must provide accurate shipping information.
- Payment must be completed through the Platform's checkout system.
- Buyers should review listings carefully, including compatibility information, before purchasing.
- Buyers must report any issues with received items within 3 days of delivery.
- Chargebacks initiated outside the Platform's dispute system may result in account suspension.
4. Prohibited Items
The following items may not be listed or sold on the Platform:
- Stolen property or parts with removed/altered VIN numbers
- Counterfeit or replica parts misrepresented as genuine
- Parts that have been recalled and not repaired
- Hazardous materials (fuel, oil, batteries without proper packaging)
- Weapons, ammunition, or explosive devices
- Items that violate any applicable law or regulation
- Parts from vehicles involved in undisclosed accidents or flood damage
5. Fees and Payments
SecondGear may charge fees for certain services, including listing fees, transaction fees, and payment processing fees. Current fee schedules are available on the Platform. We reserve the right to change our fee structure with 30 days' notice to users.
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. SecondGear does not store your payment card details.
6. Shipping and Delivery
Sellers are responsible for shipping items to buyers using the Platform's integrated shipping system or their own shipping methods. Tracking information must be provided for all shipments. SecondGear is not responsible for items lost or damaged during shipping, but will assist in resolving disputes between buyers and sellers.
7. Returns and Disputes
SecondGear is a used parts marketplace — we do not operate a traditional retail return policy. Instead, we provide a structured dispute resolution system. If an item is significantly not as described, damaged during shipping, or not received, buyers may file a dispute through the Platform. Our team will review disputes and may issue full refunds, partial refunds, or determine no action is needed based on the evidence.
- Disputes must be filed within 3 days of delivery confirmation.
- Sellers have 3 days to respond to a dispute before it is automatically escalated to admin review.
- Both parties will have the opportunity to present evidence and communicate through the dispute system.
- Partial refund amounts are determined based on the severity of the issue (see our Buyer Protection page for refund guidelines).
- SecondGear's dispute resolution decisions are final.
- Refunds are processed to the original payment method via Stripe.
- Buyer's remorse, change of mind, or compatibility issues where the listing was accurate are not eligible for disputes.
8. Intellectual Property
The Platform and its original content, features, and functionality are owned by SecondGear and are protected by copyright, trademark, and other intellectual property laws. "Harley-Davidson" and related trademarks are the property of Harley-Davidson Motor Company. SecondGear is not affiliated with, endorsed by, or sponsored by Harley-Davidson Motor Company.
9. User Content
By posting content on the Platform (listings, reviews, messages, images), you grant SecondGear a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Platform. You represent that you own or have the right to use any content you post.
10. Limitation of Liability
SecondGear acts as a marketplace platform connecting buyers and sellers. We are not a party to transactions between users. To the maximum extent permitted by law, SecondGear shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any transactions conducted through it.
11. Account Termination
We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the Platform and its users. You may also delete your account at any time through your account settings.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
